The deal, in plain terms.

BurnCap is an AI cost monitoring and budget-guardrail service operated by Eastbase Studio (“BurnCap”, “we”, “us”). You can reach us at support@eastbase.studio.

By creating an account or using BurnCap, you agree to these Terms and to our Privacy Policy. If you’re using BurnCap for an organization, you confirm you’re authorized to accept these terms on its behalf.

BurnCap monitors AI spend out-of-band. You send us usage (via an OpenAI or Anthropic import, a CSV upload, or our SDK/Events API) and we attribute cost, forecast month-end spend, raise alerts, and expose budget status.

• BurnCap is never a proxy. Your model traffic never passes through us, so we can never slow it down or take it offline.
• Budgets are advisory. The budget-check endpoint returns a verdict; your application decides what to do with it. BurnCap does not block or throttle your calls.
• Hard caps are still your call. A budget check can return a block action, but spend only stops if your application implements and honors that verdict in its own code. By default the check fails open, so an integration that ignores the verdict — or never calls it — is not protected.
• Costs are estimates unless labeled otherwise. We compute spend from a seeded price catalog and your overrides, and label every figure as estimated, provider-billed, or forecasted. Your provider’s invoice remains the source of truth; reconcile against it.

You’re responsible for keeping your credentials secure and for activity under your account. A workspace owner controls billing, team membership, and data deletion; invited members share the workspace’s dashboards and settings. Seats are limited by plan (1 on Free, 3 on Starter, 10 on Growth). You must be old enough to form a binding contract in your jurisdiction.

You decide what usage data and identifiers you send to BurnCap, and you are responsible for that data — including having the rights, notices, and a lawful basis to process it through BurnCap, and meeting any obligations you owe your own end users and customers.

• BurnCap is built to monitor cost, not content. Do not send prompts, model completions, secrets, API keys or other credentials, raw personal data, or sensitive customer information in any field — including feature, customer_id, request_id, session_id, environment, CSV uploads, or the free-form event metadata object. We store these fields as you send them and do not inspect, filter, or redact their contents.
• Use stable, pseudonymous identifiers — an internal user/account ID or a hashed value — rather than raw emails, names, phone numbers, customer content, or other sensitive identifiers.
• You are responsible for what your invited members do within your workspace.

Only connect provider credentials (such as OpenAI or Anthropic admin API keys) that you are authorized to use, and prefer the least-privileged credential that can read usage where your provider offers one. A connected key is encrypted at rest and used only to read your organization’s usage and cost data. You can disconnect a provider at any time from Integrations; when you do, BurnCap deletes the stored key from its active database and stops importing. To fully revoke a key, also revoke it in your AI provider’s dashboard.

BurnCap API keys are secrets that authorize sending usage and reading budget status for your workspace. Keep them server-side and confidential: store them in environment variables or a secrets manager, and never embed them in client-side or browser code, public repositories, logs, screenshots, or untrusted third-party tools. You are responsible for activity resulting from a key you have exposed; revoke and replace a key immediately if you suspect it has leaked — BurnCap cannot detect or prevent misuse of an exposed key.

Public API access is subject to per-key rate limits and your plan’s usage-record quota. The agent prompts and @burncap/sdk are provided to help you integrate; you remain responsible for the code that runs in your application, including how you act on budget verdicts.

You agree not to:

• Abuse, overload, or attempt to circumvent rate limits or plan quotas on the API.
• Access another workspace’s data, or reverse-engineer the service.
• Upload data you don’t have the right to process, or use BurnCap for unlawful ends.
• Resell the service without our written agreement.

BurnCap offers a free plan and paid plans — Starter ($19/month) and Growth ($39/month). Paid plans are billed monthly in advance through Lemon Squeezy, our merchant of record, and renew automatically each month until cancelled. Upgrades apply immediately and are prorated; downgrades take effect at the end of your current billing period. Cancellation, downgrade, and refund details are in our Refund & Cancellation Policy. We may change plan pricing or limits with reasonable notice; changes never apply retroactively to a period you’ve already paid for.

BurnCap relies on third parties (for example Lemon Squeezy for billing, Resend for email, and Vercel for hosting) and connects to providers you authorize (OpenAI, Anthropic). Your use of those providers is governed by their own terms, and we’re not responsible for their availability or actions.

BurnCap is provided “as is”, without warranties of any kind. We don’t warrant that estimates will match your provider invoices, that forecasts will be accurate, or that the service will catch every cost event.

BurnCap does not guarantee that it will prevent overspending. It is monitoring and decision-support software — not financial, accounting, tax, procurement, security, or FinOps advice — and you remain responsible for the cost controls, budgets, and limits in your own systems and provider accounts.

To the maximum extent permitted by law, BurnCap and Eastbase Studio will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost business opportunities, lost data, AI provider charges, unexpected model spend, or costs caused by your application not implementing or honoring BurnCap budget-check verdicts.

To the maximum extent permitted by law, BurnCap’s total aggregate liability for all claims relating to the service will not exceed the greater of: (a) the amount you paid to BurnCap in the three months before the event giving rise to the claim; or (b) USD $100.

Some jurisdictions do not allow certain liability limitations, so some of the above limitations may not apply to you.

You can stop using BurnCap at any time. You can delete a workspace’s usage data yourself from Settings (immediate), and you can delete your account by emailing support@eastbase.studio — we remove your personal data and owned workspaces from our active systems within 30 days. We may suspend or terminate access for breach of these terms or to protect the service. On termination, the plan and data provisions of our Privacy Policy and Refund & Cancellation Policy continue to apply.

We may update these Terms; we’ll revise the date above and give notice of material changes. Questions? Email support@eastbase.studio.

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law principles.

Before starting a formal dispute, you agree to contact us at support@eastbase.studio so we can try to resolve the issue informally.

If a dispute cannot be resolved informally, it will be handled by the competent courts in Vietnam, unless applicable consumer protection laws in your country or region require otherwise.

Nothing in these Terms limits any non-waivable rights you may have under applicable consumer protection laws.
