The deal, in plain terms.
These terms govern your use of BurnCap. They're written to be readable — but they are a binding agreement, so please read them.

1. Acceptance
By creating an account or using BurnCap, you agree to these Terms and to our Privacy Policy. If you’re using BurnCap for an organization, you confirm you’re authorized to accept these terms on its behalf.
2. What BurnCap does — and doesn't do
BurnCap monitors AI spend out-of-band. You send us usage (via an OpenAI or Anthropic import, a CSV upload, or our SDK/Events API) and we attribute cost, forecast month-end spend, raise alerts, and expose budget status.
- BurnCap is never a proxy. Your model traffic never passes through us, so we can never slow it down or take it offline.
- Budgets are advisory. The budget-check endpoint returns a verdict; your application decides what to do with it. BurnCap does not block or throttle your calls.
- The check fails open. If BurnCap is unreachable, the SDK allows your call to proceed — monitoring should never take down your app.
- Costs are estimates unless labeled otherwise.We compute spend from a seeded price catalog and your overrides, and label every figure as estimated, provider-billed, or forecasted. Your provider’s invoice remains the source of truth; reconcile against it.
3. Accounts & workspaces
You’re responsible for keeping your credentials and API keys secure and for activity under your account. A workspace owner controls billing, team membership, and data deletion; invited members share the workspace’s dashboards and settings. Seats are limited by plan (1 on Free, 3 on Starter, 10 on Growth). You must be old enough to form a binding contract in your jurisdiction.
4. Acceptable use
You agree not to:
- Abuse, overload, or attempt to circumvent rate limits or plan quotas on the API.
- Access another workspace’s data, or reverse-engineer the service.
- Upload data you don’t have the right to process, or use BurnCap for unlawful ends.
- Resell the service without our written agreement.
5. Plans, billing & payment
BurnCap offers a free plan and paid plans — Starter ($19/month) and Growth ($39/month). Paid plans are billed monthly in advance through Lemon Squeezy, our merchant of record. Upgrades apply immediately and are prorated; downgrades take effect at the end of your current billing period. Cancellation, downgrade, and refund details are in our Refund & Cancellation Policy. We may change plan pricing or limits with reasonable notice; changes never apply retroactively to a period you’ve already paid for.
6. API & SDK use
Public API access is authenticated with workspace API keys and subject to per-key rate limits and your plan’s event quota. The agent prompts and @burncap/sdk are provided to help you integrate; you remain responsible for the code that runs in your application, including how you act on budget verdicts.
7. Third-party services
BurnCap relies on third parties (for example Lemon Squeezy for billing, Resend for email, and Vercel for hosting) and connects to providers you authorize (OpenAI, Anthropic). Your use of those providers is governed by their own terms, and we’re not responsible for their availability or actions.
8. Disclaimers
BurnCap is provided “as is”, without warranties of any kind. We don’t warrant that estimates will match your provider invoices, that forecasts will be accurate, or that the service will catch every cost event. BurnCap is a monitoring and decision-support tool — it is not a guarantee against overspending, and you remain responsible for controls in your own systems.
9. Limitation of liability
To the maximum extent permitted by law, BurnCap and Eastbase Studio will not be liable for any indirect, incidental, or consequential damages, or for any AI provider charges you incur. Our total liability for any claim is limited to the amount you paid us in the three months before the claim.
10. Termination
You can stop using BurnCap and delete your data at any time. We may suspend or terminate access for breach of these terms or to protect the service. On termination, the plan and data provisions of our Privacy Policy and Refund & Cancellation Policy continue to apply.
11. Changes & governing law
We may update these Terms; we’ll revise the date above and give notice of material changes. These Terms are governed by the laws of the State of Delaware, United States. Questions? Email support@eastbase.studio.
